Introduction

Welcome to Brain Tunnelgenix Technologies Corp. ("btt Corp.," "we," "us," or "our"). These Terms of Use ("Terms") govern access to and use of our website (the "Site") and related services. By accessing or using the Site, you agree to comply with these Terms. If you do not agree, please do not use the Site.

Scope of the User Agreement

The Site provides information about btt Corp., its technology, its published research, and its clinical research programs. It is intended for a general audience, including health care professionals, researchers, journalists, and investors.

The Site does not provide medical advice, diagnosis, and using it does not create a physician-patient relationship. Always seek the advice of a qualified health care provider with any question about a medical condition.

Registration and Account Security

  • You must be at least 18 years old to create an account on the Site. This age limit applies to the Site only; it is not a limitation on any device's cleared indication.
  • You agree to provide accurate and complete information during registration and to keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
  • btt Corp. reserves the right to suspend or terminate accounts that contain false, misleading, or incomplete information.

Permitted Uses and User Conduct

Users agree not to:

  • Engage in illegal activities through the Site.
  • Attempt to harm the Site's functionality, including hacking, introducing malware, or reverse engineering.
  • Use the Site in a manner that infringes intellectual property rights, privacy, or applicable laws.
  • Provide false information, obtain unauthorized access, or engage in fraudulent activities.

Content Ownership and License

btt Corp. owns the Site and its content, including text, graphics, logos, images, and software. If you submit content to the Site — for example, a message through a contact form — you keep whatever rights you already hold in it, and you grant btt Corp. a nonexclusive, worldwide, royalty-free license to use that content to respond to you, to operate and improve the Site, and to meet legal obligations.

We handle personal information as described in our Privacy Policy, which is part of these Terms. We do not use information collected through the Site for scientific research. Information collected in a clinical study is governed by that study's IRB-approved Informed Consent Form and HIPAA Authorization, and is never used for marketing.

Intellectual Property Rights

All trademarks, copyrights, patents, and proprietary technologies present on the Site remain the exclusive property of btt Corp. Unauthorized use, reproduction, or distribution of any content from the Site is strictly prohibited.

Modifications and Service Availability

btt Corp. reserves the right to modify, update, suspend, or discontinue the Site or any of its features without prior notice. We are not liable for service interruptions, maintenance, or periods of unavailability.

We may update these Terms. When we do, we will change the "Last updated" date at the bottom of this page. For material changes, we will give notice on the Site at least 30 days before they take effect. Changes are not retroactive. If you keep using the Site after a change takes effect, you accept the updated Terms; if you do not agree, stop using the Site.

Disclaimers and Limitation of Liability

  • The Site is provided "as is" and "as available," without warranties of any kind.
  • btt Corp. does not guarantee that the Site will meet your specific needs, nor that it will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, btt Corp. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the Site.

To the maximum extent permitted by law, our total liability for all claims relating to the Site is limited to one hundred U.S. dollars (US$100). Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, death or personal injury, or anything else that cannot be limited by law.

These limits do not apply to any claim arising from participation in a clinical study, which is governed by that study's Informed Consent Form. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.

Account Termination and Suspension

btt Corp. reserves the right to suspend or terminate user accounts at its discretion, particularly in cases of violation of these Terms. Users may terminate their accounts at any time through the Site's settings (where applicable).

When an account is closed, we handle the information associated with it as described in our Privacy Policy. Sections of these Terms that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and dispute resolution — remain in effect.

Dispute Resolution and Governing Law

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO TAKE PART IN A CLASS ACTION.

Governing law. These Terms and any dispute arising from them or from your use of the Site are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules.

Informal resolution first. Before starting arbitration, write to us at info@bttcorp.com describing the dispute and the relief you want. We will try to resolve it with you for 60 days. This step is required for both of us.

Arbitration. If we cannot resolve the dispute informally, it will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, seated in Miami-Dade County, Florida. Judgment on the award may be entered in any court with jurisdiction. You and btt Corp. each waive the right to a jury trial.

Fees. We will pay the arbitration filing and arbitrator fees for any claim of US$10,000 or less, unless the arbitrator finds the claim frivolous. You may take part by phone or video, so you do not have to travel.

No class actions. Disputes will be resolved individually. Neither you nor btt Corp. may bring a class, collective, consolidated, or representative action. If this paragraph is found unenforceable for a particular claim, that claim will proceed in court and the rest of this section still applies.

What is not covered. This section does not apply to: (a) claims that qualify for small claims court, which either of us may bring there; (b) requests for an injunction or other equitable relief to protect intellectual property; and (c) any claim arising from participation in a clinical study, including any claim of injury, which is governed by that study's Informed Consent Form and by applicable law, not by these Terms.

Opt-out. You may opt out of arbitration by writing to legal@bttcorp.com within 30 days of first accepting these Terms, stating your name and that you opt out. Opting out does not affect any other part of these Terms.

Court proceedings. For any dispute not subject to arbitration, you and btt Corp. agree to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

Time limit. Any claim must be brought within one year after it arises, to the extent the law allows.

If you use the Site from outside the United States, nothing in this section takes away any right you have under the mandatory consumer protection law of the country where you live.

Regulatory Status

The Abreu BTT 700 System is an FDA-cleared device (K100843) for continuous skin temperature monitoring in clinical settings. It is a prescription device and is not sold or made available to consumers through the Site. Computerized Brain-Guided Thermal Therapy (CBIT) and the Abreu BTT 700 Temperature Management System are investigational. They are not FDA-cleared and have not been shown to be safe or effective for any use. Nothing on the Site is an offer to sell, or a solicitation to use, an investigational device.

Clinical Research

The Site is not a way to enroll in any clinical study, and nothing on the Site is an invitation to participate in one. btt Medical Institute conducts clinical research separately, under the oversight of an Institutional Review Board. Participation is governed only by the study's IRB-approved Informed Consent Form, and never by these Terms.

Our Privacy Policy, Cookie Policy, and Cancellation Policy are part of these Terms. By using the Site, you agree to them as well.
